TERMS AND CONDITIONS

1. About These Terms
These Terms and Conditions ("Terms") govern all sales of robotic mowing equipment and related services made by Precision Lawn Robotics ("we", "us", "our") with registered address at Estate Corner, Courthay Orchard, Pitney, Langport, Somerset, TA10 9AE. By purchasing equipment from us you agree to be bound by these Terms.
All sales are conducted in person. We do not sell products via our website. These Terms apply to all in-person sales and installations of robotic mowing machines unless otherwise expressly agreed in writing by a director of Precision Lawn Robotics.
We reserve the right to update or amend these Terms at any time. The Terms in force at the date of your purchase shall apply to your transaction.
2. Prices and VAT
All prices quoted to you at the time of sale are inclusive of VAT at the current prevailing UK rate unless expressly stated otherwise. We reserve the right to adjust prices to reflect any changes in VAT rates imposed by HMRC between the date of quotation and the date of invoice.
Any quotation given to you remains valid for 30 days from the date of issue unless withdrawn by us earlier. A quotation does not constitute a binding contract until a sale has been agreed in person and an invoice issued.
3. Payment Terms
Payment of the full invoice amount is due within five (5) working days of your receipt of our invoice. Payment details will be set out on the invoice itself. Please note the following conditions:

We do not accept payment by cheque under any circumstances.

We accept bank transfer (BACS/CHAPS), debit card, and credit card, as detailed on the invoice.

All payments must be received and cleared in full before title in the goods passes to you (see Clause 4 below).

If payment is not received within the agreed period we reserve the right to charge interest on the outstanding amount at the rate of 8% per annum above the Bank of England base rate, calculated on a daily basis from the due date until the date of actual payment, pursuant to the Late Payment of Commercial Debts (Interest) Act 1998 where applicable.

We further reserve the right to withhold delivery or installation of any outstanding equipment and to recover any goods already delivered where payment has not been made in full.
4. Retention of Title
All equipment supplied by Precision Lawn Robotics remains our sole and absolute property until we have received payment in full (including any applicable VAT and charges) and that payment has cleared in our account. Until legal title passes to you:

You must store the equipment in a manner which clearly identifies it as our property and keep it separately from any other goods.

You must not sell, transfer, charge, mortgage, pledge, or otherwise encumber the equipment.

We may at any time require you to return the equipment to us and, if you fail to do so promptly, we reserve the right to enter your premises to recover the equipment.

You bear the risk of loss or damage to the equipment from the time it is delivered or installed at your premises, notwithstanding that title has not yet passed.
5. Delivery and Installation
Delivery and installation dates are given in good faith but are estimates only. Precision Lawn Robotics shall not be liable for any loss, damage, or expense arising directly or indirectly from any delay in delivery or installation, however caused.
You are responsible for ensuring that the installation site is accessible, safe, and ready to receive the equipment on the agreed date. Any costs incurred as a result of a failed or aborted installation visit due to your failure to prepare the site may be charged to you.
Risk in the goods passes to you upon delivery or, where we install the equipment, upon completion of the installation.
6. Returns and Cancellations
6.1 How to Initiate a Return
All return requests must be initiated by email to:

Your email must be sent within fourteen (14) calendar days of the date of installation or sale of the robotic machine (whichever is the earlier) and must include all of the following information:

Installation date

Model of the robotic machine
-
Invoice number
-
Your full name
-
Your full address
-
Your contact telephone number
-
Your reason for the return
Any return request that does not include all of the above details may be delayed or rejected until the information is supplied.
6.2 Acceptable Reasons for Return
We will consider return requests where the reason relates to a genuine fault, defect, or a material mis-description of the goods. We will assess each request on its own merits in accordance with the Consumer Rights Act 2015 and any other applicable UK consumer legislation.
6.3 Unacceptable Reasons for Return
We will not accept returns where the stated reason is, in substance, that the customer has simply changed their mind. By way of example (but without limitation), the following reason will not be accepted:
"I just don't want it now."
As all sales are made in person following a demonstration and/or discussion of the product, customers are expected to have satisfied themselves as to the suitability of the equipment before completing the purchase. We strongly encourage you to ask any questions you may have at the point of sale.
6.4 Return Process
Where a return is accepted we will advise you of the appropriate return procedure. Equipment must be returned in a clean and, where possible, undamaged condition. We reserve the right to make a reasonable deduction from any refund to reflect any diminution in the value of the equipment caused by your handling beyond what is necessary to assess it.
We will process any refund to which you are entitled within fourteen (14) days of agreeing the return, using the same payment method you used for the original purchase.
7. Manufacturer's Warranty
All robotic mowing equipment is supplied with the benefit of the relevant manufacturer's warranty. The duration and terms of any such warranty will vary by brand and model; full details are set out in the documentation supplied with your machine.
In the event that your machine develops a fault within the warranty period, please contact us in the first instance. As an authorised dealer we will liaise with the manufacturer or their nominated repair agent on your behalf. Warranty repairs may need to be carried out by manufacturer-approved service centres.
The manufacturer's warranty does not cover:

Fair wear and tear;

Damage caused by misuse, neglect, or failure to follow the manufacturer's operating instructions;

Damage caused by incorrect installation of the boundary wire or other peripheral equipment;

Consumable items such as cutting blades, which require regular replacement as part of normal maintenance;

Any modification or attempted repair carried out by anyone other than an authorised service technician.
The manufacturer's warranty is in addition to and does not affect your statutory rights as a consumer.
Precision Lawn Robotics will not be liable for any additional costs incurred whilst goods are being assessed or repaired under warranty, including but not limited to any charges for hire of alternative machinery or equipment.
8. Limitation of Liability
Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
Subject to the above, our total liability to you in connection with any transaction shall not exceed the total price paid by you for the equipment in question.
We shall not be liable for any indirect, consequential, or special loss or damage, including but not limited to: loss of profit, loss of business, loss of anticipated savings, or loss of data, even if we have been advised of the possibility of such losses.
In particular, Precision Lawn Robotics shall not be liable for:

Any delays to your projects caused by late delivery or unavailability of equipment;

The cost of hiring alternative machinery whilst your equipment is unavailable;

Any failure of the machine arising from your failure to follow the manufacturer's instructions or to carry out recommended maintenance.
Use of all equipment is entirely at your own risk. You are responsible for operating the machine safely and in accordance with the manufacturer's instructions and all applicable safety legislation.
9. Complaints
If you are unhappy with any aspect of your purchase or our service, please contact us in the first instance by email at info@precisionlawnrobotics.co.uk. We will acknowledge receipt of your complaint within five (5) working days and advise you of the likely timescale for resolution. We are committed to resolving all complaints fairly and promptly.
This complaints procedure does not affect your statutory rights as a consumer.
10. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
11. Your Statutory Rights
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable UK consumer protection legislation. For further information about your statutory rights you may contact Citizens Advice or the Citizens Advice consumer helpline.
12. Data Protection and Privacy
Precision Lawn Robotics is committed to complying with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Any personal data collected from you in connection with your purchase will be used solely for the purposes of processing and fulfilling your order, providing after-sales support, and complying with our legal obligations. We will not share your personal data with third parties for marketing purposes.

13. General
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.
Our failure to enforce any provision of these Terms shall not be construed as a waiver of our right to enforce it subsequently.
These Terms, together with any invoice or written quotation provided to you, constitute the entire agreement between you and Precision Lawn Robotics in relation to your purchase and supersede all prior representations, agreements, or understandings.
